Records Integrity and Data Breach
Questions 17 through 25

RASC Analyst Ida Fong, CFO Stephen Agostini, and the Data Breaches

This document was prepared with reasonable care to ensure accuracy of all citations, hyperlinks, and factual references as of its date of submission. Given the complexity of the record — spanning 37 years, multiple UC administrative systems, and over 30 exhibits — unintentional errors in citation format, hyperlink availability, or cross-reference numbering may exist. Any such errors are ministerial in nature and do not affect the substance of the questions presented or the underlying documentary evidence. The author welcomes correction of any inaccuracy identified by the Plan Administrator.

Section C: Records Integrity and Data Breach Questions (Q17–Q25)

Question 17
Ida Fong / my son, February–March 2021

Documents: On February 24, 2021, UC Benefits employee Ida Fong called Harold regarding my son who was listed as “disabled” in UC’s system. My son was never disabled. Harold IS the family member with the documented permanent disability determination. On March 18, 2021, Fong called again from (510) 987-0665, duration 16 minutes 3 seconds. Fong processed a premium refund for my son’s overpaid premiums. Fong stated records were “lost during computer system upgrades.” Harold’s March 12, 2021 email to Fong memorializes these events contemporaneously. UC issued the refund. My son was removed from the 1095-B by 2022.

(a) UC corrected my son’s records (my son was never disabled), issued a premium refund, and removed my son from the 1095-B — all within approximately one year. Why did UC not simultaneously restore Harold’s disability classification, given the documented Octagon permanent disability determination (August 8, 2001) that has never been revoked?

(b) Which specific computer system upgrade caused the record loss? What specific records were lost? What steps were taken to recover or reconstruct them?

Question 18
The Contemporaneous Record — March 12, 2021 Email

Document: Harold’s March 12, 2021 email to Ida Fong is timestamped and contemporaneous. UC acted on this email by issuing a premium refund for my son and by removing my son from subsequent 1095-B forms. These are contemporaneous, timestamped, UC-acted-upon documents — not retroactive fabrications.

Does the Plan Administrator accept the March 12, 2021 email and UC’s subsequent refund issuance as evidence that (a) UC’s disability coding system was corrupted (the wrong family member was coded as disabled), and (b) UC had contemporaneous notice that Harold’s disability classification required correction?

Question 19
UC Corrected my son But Not Harold

Documents: UC corrected my son’s erroneous disability coding, issued a premium refund, and removed my son from the 1095-B — all within approximately one year of discovering the error. Despite the same February 24, 2021 conversation establishing that the disability coding had been applied to the wrong family member, Harold’s own disability classification has never been restored in over five years.

Please explain this disparity.

Question 20
UCLA CFO Stephen Agostini — Failed System Upgrade and Erroneous Records

Documents: In a February 6, 2026 interview published by the Daily Bruin on February 13, 2026, UCLA Vice Chancellor and Chief Financial Officer Stephen Agostini stated that UCLA’s annual financial reports posted on its website since 2002 are “erroneous and unaudited.” He identified a $425 million structural deficit resulting from “financial management flaws and failures.” He stated the Ascend Finance Transformation Project — UCLA’s initiative to replace its legacy mainframe financial system designed in the 1980s with Oracle Cloud — cost at least $213 million over seven years, including $150 million with “nothing to show for it.” Chancellor Julio Frenk fired Agostini on February 17, 2026 — four days after publication.

(a) The “since 2002” window identified by UCLA’s own CFO encompasses the entire period of Harold’s records disputes: the 2003 workers’ compensation settlement, the 2014–2015 reclassification from disability to retirement income, the initiation of premium deductions, and the disappearance of workers’ compensation settlement records. What steps, if any, has the Plan Administrator taken to determine whether Harold’s records were affected by the system failures UCLA’s CFO publicly confirmed?

(b) Is the legacy mainframe system from the 1980s that Agostini described the same system that stored Harold’s 1996 disability classification and 2003 settlement records?

(c) Provide documentation of any investigation into the impact of these confirmed system failures on Harold’s records.

Question 21
Data Breaches — Individual Impact Assessment Required

Documents: For EACH of the following documented data breaches, please state separately: (1) Was Harold notified as required by law? (2) Was any investigation conducted regarding the impact on Harold’s specific records? (3) If so, provide the results. (4) If not, state that for the record.

(a) Breach #7: Anthem (February 18, 2014 – January 27, 2015 discovery). 78.8 million records compromised. Compromised data explicitly included “employment information and income data.” Harold’s disability-to-retirement reclassification occurred during this exact breach window.

(b) Breach #8: UCLA Health System (July 2014 – May 2015). 4.5 million patient records breached. Overlaps directly with Harold’s reclassification period.

(c) Breach #12: UC Accellion (December 24, 2020). 547,000+ UC individuals’ data compromised. Compromised data explicitly included disability accommodation information — precisely the category of data at issue in Harold’s case. The same year Harold’s account number first changed.

(d) Breaches #13–19: Seven Separate Anthem Breaches (January 12, January 21, May 1, June 30, and additional dates in 2021). Occurring during the same period UC employee Ida Fong admitted records were “lost during computer system upgrades” and discovered the disability coding error.

Identify what portions of Harold’s UC file were compromised, corrupted, or modified during any documented breach.

Question 22
Anthem Blue Cross Portal — Coverage History

Documents: Harold’s Anthem Blue Cross member portal (Member ID U5X***87210) displays only three plan periods: January 1, 2024 – December 31, 2024; January 1, 2025 – December 31, 2025; and January 1, 2026 – Present. No records exist prior to January 1, 2024 despite 20+ years of continuous coverage and premium payments. Additionally, $14,094.36 in paid claims were documented on the portal and subsequently erased. The December 21, 2023 – January 4, 2024 inpatient hospitalization for Valley Fever (Coccidioidomycosis) is completely absent from all Anthem portal records.

(a) Reconcile the Anthem portal showing records only from January 1, 2024 with UC’s own 1095-B forms confirming continuous coverage from at least 2016 through 2025.

(b) $14,094.36 in documented paid claims were erased from the portal. What happened to these claims? Who authorized their removal?

(c) Harold’s December 21, 2023 – January 4, 2024 inpatient hospitalization for Valley Fever is completely absent from the insurer’s records. Please explain how a 14-day inpatient hospitalization can be absent from the insurer’s portal.

Question 23
Anthem Notification Failures

Documents: Zero notification letters were sent to Harold by Anthem Blue Cross in 24 months. One notification was sent to Harold’s wife at the Arizona address on September 27, 2025 — proving Anthem had the Arizona address six months before the coverage termination. The 2025 Summary of Benefits and Coverage is missing from the Anthem portal.

(a) Why did Harold receive zero notifications from Anthem while his wife received one notification at the same Arizona address?

(b) Produce the 2025 Summary of Benefits and Coverage or explain its absence from the portal.

Question 24
Anthem Member ID Discrepancy

Document: Harold’s post-Medicare Anthem Member ID ending in 87210 was retroactively applied to pre-Medicare coverage years on the Anthem portal display.

Please explain why a post-Medicare Member ID was applied retroactively to years when Harold was not enrolled in Medicare.

Question 25
Allison Cumming / Elevance Health — Recorded Termination Date

Document: Allison Cumming, Elevance Health Executive Concierge (Anthem’s parent company), proactively engaged with Harold regarding his coverage and recorded a coverage termination date of April 30, 2026 in her correspondence.

How does the Plan Administrator reconcile this recorded termination date of April 30, 2026 with the “status quo” preservation stated in Ms. Morse’s April 9, 2026 letter?
