VI. Time Limits and Filing

UC Whistleblower Protection Policy 1100563 § C (Filing Procedures)
The Retaliation Complaint must be filed within twelve (12) months of the Adverse Personnel Action. If the complaint alleges a pattern of retaliation, it must be filed within twelve (12) months of the most recent Adverse Personnel Action. A Retaliation Complaint is considered filed on the date it is postmarked, personally delivered, faxed, or emailed.

Statute compliance. The most recent Adverse Personnel Actions catalogued in Section IV occurred on April 9, 2026 (Erin Morse 90-Day Review structure) and April 17, 2026 (UCLA Compliance closure of CMP373 without interview). This Sworn Retaliation Complaint is filed on April 30, 2026 — thirteen and twenty-three days after those actions, respectively, and well within the twelve-month statute. Each individual Adverse Personnel Action catalogued in Section IV is independently within the twelve-month window.

More recently still, on or about May 1, 2026, the University of California unilaterally altered the Complainant’s pension paycheck by entering a phantom deduction of $727.48 — the exact amount of the premium UC had stopped collecting in January 2026 — and applying that entry against the Complainant’s May 1, 2026 pension payment, all without prior written notice, without consent, and without lawful authority. This unilateral paycheck alteration is itself an Adverse Personnel Action under Policy 1100563 § B, occurring one day after the filing date of this Complaint, and is independently within the twelve-month statute.

Continuing-jurisdiction note. The underlying workers’ compensation matter remains within the continuing jurisdiction of the California Workers’ Compensation Appeals Board pursuant to California Labor Code § 5803. No WCAB modification order has issued. The Complainant’s August 8, 2001 Octagon permanent-and-stationary determination has not been revoked. The protected workers’-compensation status that anchors the Labor Code § 132a predicate (Section V, paragraph 2) is therefore a continuing condition, not a closed matter.

Filing channels. This Sworn Retaliation Complaint is filed simultaneously through the following channels, each of which independently establishes a filing date under Policy 1100563 § C:

  1. Email to compliance@compliance.ucla.edu
  2. Email to the UCOP Systemwide Locally Designated Official
  3. U.S. Express Mail to UCLA Compliance Office, 10920 Wilshire Boulevard, Suite 700, Los Angeles, CA 90095-1366
  4. CC to University of California Office of the President
